The International Criminal Court (ICC) has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, and former Defense Minister Yoav Gallant, accusing them of war crimes and crimes against humanity. This marks the first time Netanyahu or any Israeli official has been indicted by an international tribunal for actions related to the ongoing conflict in Gaza.

Benjamin Netanyahu has become the first leader of a “western-style” democracy to face such charges from the ICC. The warrants pertain to the Hamas attacks on Israel on October 7, 2023, and the subsequent Israeli military response in Gaza.

The ICC’s three-judge panel concluded there are reasonable grounds to hold Netanyahu and Gallant criminally responsible for war crimes, including using starvation as a weapon and crimes against humanity such as murder, persecution, and other inhumane acts. The judges also found evidence suggesting they are accountable as civilian leaders for intentionally targeting civilians in their military actions.

How Does the ICC Enforce Arrest Warrants?

The International Criminal Court (ICC) relies on its 124 member states, bound by the Rome Statute, to carry out arrest warrants. These states are obligated to detain individuals wanted by the ICC if they enter their territory. While compliance isn’t guaranteed, the risk of arrest often limits the accused’s travel options.

For example, last year, Russian President Vladimir Putin chose not to attend a summit in South Africa due to concerns he might be arrested under an ICC warrant for alleged involvement in the abduction of Ukrainian children during Russia’s invasion of Ukraine.

Neither Israel nor its ally, the United States, are ICC members, nor are potential venues for Gaza ceasefire talks, such as Qatar and Egypt. However, this may be irrelevant as Netanyahu and Gallant have yet to attend any negotiations. Among Arab nations, only Jordan, Tunisia, and Palestine are ICC members. Germany, a strong Israeli ally, is also a member, along with all European Union countries, Switzerland, Japan, and most Latin American nations except Cuba and Haiti. Additionally, 33 African countries are members of the ICC.

The ICC has the authority to investigate crimes either committed by citizens of member countries or within the territory of a member state. In 2015, Palestine joined the Rome Statute, and in 2021, the ICC recognized it as a state. This decision extended the court’s jurisdiction to areas occupied by Israel since 1967, including Gaza, the West Bank, and East Jerusalem.

How Are Countries Responding to the ICC Arrest Warrants?

European Union:
The EU’s foreign policy chief, Josep Borrell, stated that all EU member states are obligated to comply with the ICC warrants. Italy’s Defense Minister Guido Crosetto confirmed that the country would be required to arrest Netanyahu if he entered Italy. Similarly, the Netherlands expressed readiness to act on the warrants, with Foreign Minister Caspar Veldkamp emphasizing the importance of respecting the ICC’s independence. France also supported the ICC’s actions but stopped short of confirming whether it would arrest Netanyahu, citing legal complexities.

Sweden reiterated its commitment to the ICC’s independence, noting that Swedish law enforcement would handle arrests. Ireland’s Prime Minister Simon Harris called the warrants a significant development, urging swift action in supporting the ICC.

Norway:
Norway’s Foreign Minister Espen Barth Eide voiced confidence in the ICC’s ability to handle the case fairly and called for adherence to its mandate.

Jordan:
Jordan’s Foreign Minister Ayman Safadi stated that ICC rulings must be respected and enforced, adding that justice for Palestinians is essential.

Canada
Canada’s Prime Minister Justin Trudeau affirmed that Canada would honor all ICC rulings.

UK:
The UK government has avoided confirming whether it would arrest Netanyahu if he visited Britain, despite being an ICC member state. Legal experts argue there is an obligation to enforce the warrant. However, Prime Minister Keir Starmer’s government has only stated that it respects the ICC’s independence as the key body for addressing serious international crimes.

United States:
The White House has strongly rejected the ICC’s decision, expressing deep concern over what it sees as a rushed move to issue arrest warrants, as well as the errors in the process leading to the decision. A National Security Council spokesperson emphasized that the U.S. believes the ICC lacks jurisdiction over this matter.

Will the ICC Arrest Warrants Truly Change the Course of Justice?

The issuance of arrest warrants for Benjamin Netanyahu and Yoav Gallant is undoubtedly a momentous step in the pursuit of international justice. Still, the practical implications of these warrants raise profound questions. The ICC’s authority depends on the willingness of member states to enforce its rulings, and with major powers like the United States and Israel refusing to recognize the court’s jurisdiction, the effectiveness of these warrants is called into question. While some European nations have committed to complying with the court’s directives, the political realities of international diplomacy may prevent actual arrests, particularly in countries with strong alliances to Israel.

This situation poses a broader dilemma: can the ICC, despite its legitimacy, exert meaningful influence when geopolitical interests are at play? The warrants may not lead to immediate consequences, but they send a powerful message about the growing expectations for accountability, especially regarding war crimes. Whether this leads to real change hinges on how the international community responds—not just through legal channels, but by shifting the global narrative on justice, sovereignty, and the consequences of state-led violence. The real question is whether the ICC’s actions can transcend political opposition and set a precedent for holding even the most powerful leaders accountable in the future.
