The recent arrest of Columbia University student Mahmoud Khalil has ignited widespread outrage, raising serious concerns about free speech protections in the United States. Khalil, a 29-year-old Palestinian student and a key organizer of last year’s pro-Palestine demonstrations on campus, was taken into custody over the weekend by Immigration and Customs Enforcement (ICE) agents.

Authorities have announced plans to revoke his permanent residency—commonly known as a green card—at the request of the Department of State. However, no federal charges have been filed against him. In response to the arrest, President Donald Trump took to his Truth Social platform, labeling Khalil “a radical foreign pro-Hamas student” and warning that this was “the first arrest of many to come.”

Can the U.S. Deport Khalil?

While Khalil’s deportation is legally possible, experts suggest the process would face significant legal challenges. Green card holders, though often granted rights similar to U.S. citizens, are not entirely shielded from deportation. Their residency status can be revoked under specific conditions, such as committing a crime, engaging in fraud, or being deemed a national security threat. Even in such cases, individuals have the right to contest their deportation in court.

However, political speech is not a legally valid reason for revoking a green card, according to Sarah Leah Whitson, executive director of Democracy for the Arab World Now (DAWN). “Green card holders have the same First Amendment rights as U.S. citizens,” she said, calling Khalil’s arrest a blatant attempt to silence pro-Palestinian voices.

In Khalil’s case, the burden of proof falls on the U.S. government, which must demonstrate that he has violated immigration laws or poses a legitimate security risk.

A Broader Crackdown on Campus Protests

Khalil’s arrest comes amid a broader effort by the Trump administration to target individuals involved in pro-Palestine activism. Since assuming his second term, Trump has pledged to crack down on what he calls “illegal protests” against Israel.

“Agitators will be jailed or deported to their home countries. American students will face permanent expulsion or, depending on the offense, arrest,” he wrote on Truth Social last Tuesday.

Just days later, on Friday, the U.S. government announced a $400 million (€368.7 million) cut in federal grants and contracts to Columbia University, citing its campus protests against the war in Gaza.

Implications for Free Speech

The developments at Columbia University have intensified concerns over the erosion of free speech rights in the United States. Critics argue that the Trump administration’s actions set a dangerous precedent, punishing students and activists for expressing dissenting views.

As legal battles over Khalil’s residency status unfold, the case has become a flashpoint in the ongoing debate over political expression, civil liberties, and the U.S. government’s stance on pro-Palestinian activism.
