Lawyer Jibran Nasir Unpacks the #Karsaz Incident In Legal Terms. Here’s What The Public Needs To Hear

As the debate over the Karsaz incident intensifies, news channels have turned to lawyer and activist Jibran Nasir to shed light on the legal repercussions of the case, which is still a developing story. Lawyer Jibran Nasir has offered his services to the family of the aggrieved Imran and his daughter, who died in the accident along with several others.

The case has sparked a heated online debate, with netizens and the public engaging in intense discussions about privilege, mental health issues, the treatment of the accused before guilt is proven, and the role of the legal system in helping the helpless seek justice—justice that should be neither delayed nor denied. Public sentiment fluctuates between rage and cynicism as people debate whether justice will be served in a nation under immense pressure from influential individuals to either dismiss the case or give the culprit a light sentence.

Key Points Highlighted By Jibran Nasir:

  1. The mental health condition needs to be specified. There could be a scenario where the individual was already afflicted with a mental health issue and undergoing treatment for some time before the incident occurred.
  2. There may also be a mental health condition that arose after the incident as a result of it, potentially a form of psychosis, preventing the accused from appearing in court or leading to a request for leniency based on this condition.
  3. The window for chemical examination – obtaining urine or blood samples from the accused may have passed. Any attempt now to draw blood or urine samples could result in the law enforcement agencies being unable to obtain accurate samples or results if they haven’t done so already.
  4. There is a possibility for the aggrieved family to settle the case outside of court with compensation, which could include damages and a payout equivalent to what the young girl might have contributed to her family’s income throughout her life. However, this decision should be made when the family is not grieving or under any form of mental or emotional pressure.
  5. Jibran Nasir has offered his assistance in the case and has reached out online to Imran’s family to offer his legal advice if they are in need.

However, a source familiar with the case alleged the police and health officials were involved in “a cover-up,” as the blood and urine samples had not been submitted for analysis to the laboratory despite a delay of more than 24 hours. The source suggested the delay could negatively impact the test results, supporting the defense’s claim that she was mentally unwell.
Senior Superintendent of Police (SSP) Investigation Aleena Rajpar confirmed the samples had not been dispatched further, informing that they would be sent for analysis on Wednesday morning.
She attributed the delay to a public holiday in Sindh province, marking the birth anniversary of Sufi saint Shah Abdul Latif Bhitai, adding, “The police are proceeding according to the law and merit. The lab was closed today, but the samples will be submitted tomorrow.”
Karachi Police Chief Javed Alam Odho, however, said it was not the police’s responsibility to submit the samples to the lab, noting that the hospital was responsible for this task.
Odho also said the police had taken the accused for a medico-legal examination on Monday night.
Meanwhile, Deputy Executive Director of Jinnah Hospital Dr. Yahya Tunio denied the police chief’s assertion.
“We don’t deal with medico-legal cases,” he told Arab News. “The police surgeon takes care of them. It’s their responsibility to collect, send and secure the sample.”
Dr. Summaiya Syed Tariq, the police surgeon, confirmed her department had collected the urine and blood samples of the accused, adding they had been handed over to the investigation officer.
“The lady was brought to us under police custody to rule out intoxication,” she said, noting that she was “very aggressive at the time of examination” and was referred to the Department of Psychiatry for emergency treatment.
“Blood and urine samples were handed over to the investigation officer,” she said, a claim which the SSP had also confirmed.

To, The Executive Director. JPMC. Karchi.

Subject: Discharge of Police Custody Case Mrs_ Natasha W/O Danish

Respected Sir,

I have the honor to state that Mrs. Natasha W/O Danish presented to the Accident & Emergency Department of JPMC in Police Custody dated 19th August 2024 at 9:45 PM vide CR# ER- 2024/311018 after a Road traffic accident. A call was sent by the Accident & Emergency Department to the Department of Psychiatry, JPMC, for her psychiatric evaluation because of her confused state, irritability, and abnormal behavior.

On examination by the doctors on duty, it was found that she was confused and behaving abnormally. Considering her current condition, seriousness of the incident, and her past history of psychiatric illness as stated by her family members (though no past records have been provided), she was admitted in the Department of Psychiatry Vide CR# 33146 dated 19TH August 2024 at 11:20 PM in order to prevent deliberate self-harm, risk of suicide or any other untoward event.

We kept her under observation and on repeated mental state examination and relevant psychological scales, it is found that there is no immediate deliberate self-harm or risk of suicide so she may be discharged from the Department of Psychiatry as there is no need of immediate psychiatric intervention at present

Yours faithfully,

Dr. Chooni Lal

Associate,Professor_st Incharge,

Department-of Psychiatry & Behavioural Sciences, JPMC/JSMU

“The accused is confused and unable to appear for court proceedings or interrogation,” the report stated. Dr. Ghoni Laal also confirmed that Natasha Danish had been admitted to the hospital for a comprehensive medical evaluation. The defense counsel argued that Natasha has been a psychiatric patient undergoing treatment for the past five years. A First Information Report (FIR) was filed by the brother of the deceased against Natasha, accusing her of hitting the motorcycle that led to the deaths of a man and his daughter on Monday.

In summary, the Karsaz incident is still fresh in people’s minds, and online outrage is reaching its peak. So far, the accused, Natasha Iqbal Danish, has been taken into custody under judicial remand and is due to appear in court. A medical note from the Jinnah Postgraduate Medical Center, a copy of which appears below, mentions that upon physical examination, the accused did not appear to suffer from any medical condition.

This is a developing story. We will be updating it accordingly.
